TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your access to and use of www.swflyr.com (the “Site”) and any related services, content, memberships, donations, event registrations, and communications offered by Southwest Florida Young Republicans (“SWFLYR,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1) WHO WE ARE / PURPOSE OF THE SITE
SWFLYR is a local political organization focused on hosting events, fostering civic engagement, and promoting Republican principles in Southwest Florida. Content on this Site is provided for informational and organizational purposes.
SWFLYR is not a government agency, and the Site is not an official government website.
2) ELIGIBILITY / AGE REQUIREMENTS
A. Site use
You must be at least 13 years old to use the Site. If you are under 18, you may use the Site only with the involvement/permission of a parent or legal guardian who agrees to these Terms.
B. Membership eligibility
Membership categories, eligibility requirements, and voting privileges (if any) are described on the Site at the time you join/renew. By applying for or purchasing a membership, you represent that you meet the eligibility requirements for that membership type.
We may request information reasonably necessary to confirm eligibility and may deny, suspend, or revoke a membership if we reasonably believe eligibility requirements are not met or Terms are violated.
3) ACCOUNTS / LOGIN
Some Site features may require creating an account or logging in. You agree to:
• Provide accurate, current information
• Maintain the security of your login credentials
• Notify us promptly of unauthorized access or suspected security issues
You are responsible for activities occurring under your account.
4) MEMBERSHIPS (JOINING, RENEWALS, AND BENEFITS)
A. Membership term and renewals
Memberships may be offered on an annual or other recurring basis. If your membership is set to auto-renew, you authorize us (and our platform/payment processors) to charge the applicable membership fee on each renewal until you cancel.
B. Benefits and changes
Membership benefits (including discounts, access, and voting privileges where applicable) may change from time to time. We may add, remove, or modify benefits, event access rules, and membership categories in our discretion.
C. Cancellation
You may cancel a membership renewal through your account settings (if available) or by contacting us at swflyrinfo@gmail.com. Cancellation stops future renewals; it does not necessarily provide a refund for amounts already paid, unless required by law or stated otherwise at purchase.
D. Refunds
Unless explicitly stated otherwise in writing, membership fees are non-refundable. We may make exceptions at our sole discretion or where required by law.
5) DONATIONS
A. Voluntary support
Donations made through the Site are voluntary and support SWFLYR’s organizational activities and mission.
B. Recurring donations
If you elect a recurring (e.g., monthly) donation, you authorize us (and our payment processors/platform provider) to charge your selected payment method on a recurring basis until you cancel.
C. Refunds
Donations are generally non-refundable, except where required by law or as we may determine in our sole discretion.
D. Compliance with law
You agree that any donation you make complies with all applicable laws and regulations. We may refuse, return, or refund donations when we reasonably believe doing so is necessary for legal compliance or to prevent fraud/misuse.
6) EVENTS, TICKETS, AND EVENT CHANGES
A. Event details
Event dates, times, locations, guests/speakers, prices, and other details may change. We may update event information at any time.
B. Tickets, RSVPs, and attendance
Tickets/RSVPs (if applicable) may be limited. We may require check-in, identification, or confirmation of membership status for entry or for certain member-only benefits.
C. Cancellations and refunds
Unless an event page or registration confirmation states otherwise:
• Event tickets/fees are non-refundable
• If an event is cancelled or materially rescheduled by SWFLYR, we may offer a credit, transfer, replacement event access, or refund in our discretion (and as required by law)
D. Venues and third-party rules
Events may be hosted at third-party venues. You agree to comply with venue policies and all applicable laws while attending.
E. Assumption of risk
By attending any SWFLYR event or activity, you assume all risks inherent in participation, including risks related to travel, crowds, weather, venue conditions, and health/safety. You are responsible for your own conduct and personal property.
7) CODE OF CONDUCT
You agree not to:
• Harass, threaten, intimidate, or discriminate against others
• Disrupt events or interfere with others’ participation
• Engage in unlawful activity or encourage violence or illegal conduct
• Attempt to access Site systems without authorization
• Use the Site to transmit malware, spam, or abusive content
We may remove content, deny entry to events, suspend accounts, and/or revoke membership for violations of this section.
8) PHOTOS, VIDEO, AND LIKENESS
SWFLYR events may be photographed or recorded. By attending an event or participating in SWFLYR activities, you grant SWFLYR permission to use your name, image, likeness, and/or voice in photographs or recordings for organizational purposes (including social media, promotional materials, and recaps) without compensation, unless prohibited by law.
If you have a safety or privacy concern, please contact us at swflyrinfo@gmail.com before the event when possible.
9) USER CONTENT (COMMENTS, SUBMISSIONS, AND MESSAGES)
If the Site allows comments or user submissions:
• You are responsible for your content
• You agree your content will not infringe others’ rights or violate laws
• You grant SWFLYR a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating the Site and promoting SWFLYR (e.g., featuring a comment/testimonial)
We reserve the right (but do not assume the obligation) to monitor, moderate, edit, or remove user content at any time.
10) INTELLECTUAL PROPERTY
The Site and its content (including text, graphics, logos, images, and design) are owned by SWFLYR or its licensors and are protected by applicable intellectual property laws.
You may view and share Site content for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, or create derivative works from Site content without prior written permission, except as permitted by law.
11) THIRD-PARTY LINKS AND SERVICES
The Site may link to third-party websites or services (such as social media platforms, voter registration resources, event/venue sites, and payment processors). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms and policies.
12) DISCLAIMERS
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWFLYR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Content on the Site may reference political issues, public affairs, or organizational viewpoints. Content is provided for general informational purposes and should not be relied upon as legal, tax, financial, or professional advice.
13) LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWFLYR AND ITS OFFICERS, DIRECTORS, VOLUNTEERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ATTENDANCE AT EVENTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ALL CASES, SWFLYR’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO SWFLYR THROUGH THE SITE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 IF YOU PAID NOTHING, WHICHEVER IS GREATER, EXCEPT WHERE PROHIBITED BY LAW.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
14) INDEMNIFICATION
You agree to defend, indemnify, and hold harmless SWFLYR and its officers, directors, volunteers, members, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
• Your use of the Site
• Your attendance at events
• Your violation of these Terms
• Your violation of any law or third-party rights
15) PRIVACY
Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, and share information about you.
16) CHANGES TO THE SITE OR TERMS
We may modify the Site or these Terms at any time. The “Last Updated” date above indicates when these Terms were most recently revised. Your continued use of the Site after changes become effective means you accept the updated Terms.
17) GOVERNING LAW / VENUE
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site will be brought in the state or federal courts located in Florida, and you consent to personal jurisdiction and venue in those courts.
